HMRC’s contractor tax testing tool misleading

A recent review has found that HMRC’s “check employment status for tax” (CEST) tool is routinely misleading contractors and the self-employed.

The online tool should give clarity over employment status, however, in nearly half of cases, it is erroneously shows that self-employed individuals fall inside IR35 rules.

Further investigations found that HMRC has evaluated just 24 tribunal cases as a feature of CEST testing, demonstrating that HMRC is not ensuring that the right amount of tax is collected and leading individuals into false employment.
